The national law firm of Hinshaw & Culbertson, LLP announced today that Stephen W. Tully and Timothy I. McCulloch have joined the firm as partners in the Commercial Litigation practice group, both resident in the firm’s Phoenix office. Tully and McCulloch will serve as co-partners-in-charge of the Phoenix office. They join Hinshaw from Gordon Rees Scully Mansukhani, LLP.
“Steve and Tim are exceptional commercial litigators that further enhance the firm’s ability to handle complex litigation in the Phoenix market,” said Donald L. Mrozek, Hinshaw’s chairman. “Their arrival follows on the heels of Randy Aoyama and Bradley Logan. This group brings both talent and experience to our Phoenix office. We look forward to their leadership as we continue to bolster our Phoenix presence.”
Robert J. Romero, partner-in-charge of Hinshaw’s San Francisco office and member of Hinshaw’s Management Committee, noted, “Phoenix remains a market that presents great opportunity to the firm and the clients we serve in the area. Steve and Tim bring tremendous talent and deep roots in the Arizona community. They will further create and lead Hinshaw’s Phoenix office with the other terrific lawyers and staff that make up our Southwest team.”
Tully has been actively litigating cases for more than 22 years. He has in-depth experience in complex commercial litigation including contract disputes, professional liability claims, insurance litigation, governmental/municipal litigation and investigations, securities law, construction and employment litigation. He served in the Arizona House of Representatives from 2001 to 2007 and was Majority Leader of the Arizona House from 2005 to 2007. From 2003 to 2005, Tully was chairman of both the House Judiciary Committee and the House Ethics Committee. He currently serves as a director of CopperPoint Mutual Insurance, Arizona’s largest workers’ compensation insurer, where he chairs the board’s Nominations and Governance Committee.
“We are excited about the growing Commercial Litigation practice,” said David G. Asmus, Commercial Transactions partner in the Phoenix office. “Their litigation skills across disciplines will be an important asset for us as we continue to build our Phoenix capabilities and our Firm-wide business litigation services.”
McCulloch, a licensed pilot, brings vast knowledge of the aviation industry to the Commercial Litigation practice. He has first-hand experience advising and defending banking institutions, aircraft operators, fixed-base operators and airport sponsors through foreclosure procedures, negligence claims, airport land use, Part 16 complaints, hangar condominium development and environmental issues. He has also been involved with disputes between competing fixed-based operators spurred by allegations of procurement code and federal grant assurance violations, and has advocated for aircraft owners in disputes with aircraft manufacturers and aircraft management companies. Furthermore, McCulloch has represented numerous entities and individuals prosecuted by the Federal Aviation Administration, many of which face substantial civil penalties or revocation of all certificates or both. He has an established track record of negotiated settlements with the FAA, which have resulted in substantially lessened penalties from those the agency initially sought.
“Hinshaw provides a wide-ranging platform of integrated practices that will enhance the services that we provide to our clients and create a variety of new business opportunities,” commented Mr. Tully and Mr. McCulloch.
Tully earned his B.A. from Claremont McKenna College and his J.D., cum laude, from the University of Arizona College of Law. McCulloch earned his B.A., magna cum laude, from the University of California, Irvine, and his J.D. from the University of California, Davis.
